He is accused of making unsuitable, commission-driven and fraudulent investments in variable annuity and real estate products. This is against securities laws. A broker must abide by a standard called suitability, which means he must recommend only investments that are suitable for his clients. Brokers who fail to recommend suitable investments may be subject to disciplinary action by the Financial Industry Regulatory Authority (FINRA) or the Securities and Exchange Commission (SEC). MacDonell was registered with Vanderbilt Securities Inc. from April 1989 until May 1989, The Equitable Life Assurance Society of the United States in New York, New York from June 1989 until June 1999, EQ Financial Consultants in New York from June 1989 until June 1999 and Vestax Securities Corp in Hudson, Ohio from May 1999 until June 1999. He is currently registered with Hantz Financial Services in Taylor, Michigan and has been since June 1999. He has one customer dispute pending against him.
