Richard G. Cody was charged by the Securities and Exchange Commission (SEC) with defrauding Massachusetts retirees, and has recently been indicted for deceiving and manipulating his former clients concerning the management of their retirement savings as well as lying to the SEC in sworn testimony. The indictment was filed on September 26th of this year, and charged him with violating the Investment Advisers Act of 1940 and making a false declaration in a court proceeding. Previously, Cody had denied under oath that he had provided two clients with false documents, and this turned out to be false. The SEC obtained an asset freeze against Cody and his company, Boston Investment Partners from violating certain antifraud provisions of the federal securities laws. The SEC will seek disgorgement of allegedly ill-gotten gains, plus interest and penalties, as well as permanent injunctive relief, and this is pending.
According to his online report with the Financial Industry Regulatory Authority (FINRA), Mr. Cody was previously registered with Merrill Lynch, Salomon Smith Barney, Leerink Swann & Company, Gunnallen Financial, Westminster Financial Securities, Concorde Investment Services and IFS Securities. He has 22 customer disputes against him, 19 of which are currently pending. He has been permanently barred from the industry.
